My wife and I were a couple months behind on our payments due to some unforeseen financial difficulties. We are very responsible people who have always made our payment on time up until recently. We made payment arrangements for July 25th 2008 and July 31st 2008 to get current with the back to back payments. On August 8Th Regional called my wife and asked us to set an arrangement to pay for August 12Th payment 4 days before it was even due. My wife asked why they were calling and that the payment was not due for 4 days and she would call the payment in on August 22ND(only 10 days late) and we would be on our feet again. She did not authorize a payment when the lady called. Regional has our credit card info on file from past payments. The lady on the phone said she could hold the acct with a check but would not debit the acct with a check and wanted my wife to call in a promise to pay for August 22nd with a credit card number when she was ready. Today is August 11th and Regional hit our acct for the payment and made our bank acct negative. We DID NOT authorize this payment. Regional should be shut down for dishonest practices and I am contacting an attorney first thing in the morning about this matter.

Wow!

First to Helper- Regional Acceptance cannot withdraw money from an account holder's bank account w/o authorization from the the account holder. You must give RA, or any other company, authorization to hit your account for the payment.

To withdraw the monies without your permission would amount to wire fraud of sorts- which is a felony if I'm not mistaken.

You cannot legally take monies from an individual's account w/o their permission. Its stealing. You have to give permission- via signing a form that authorizes automatic withdraws, etc.

We've never had this happen. But we've had Regional say that a payment has bounced when we had proof it didn't. They still refused to credit our account. We even mailed them a payment and they demanded that payment the day they called vs. the agreement we had. The woman told my husband to put a stop payment on the check.

When my husband demanded to be credited the $33 it would cost us to put a stop payment on the check, she told him that if he was going to be that way, she'd have us processed for repo!

Um. Wow. Never had that happen.

So, no. This isn't a case of poor folk crying over their car loans.

Why dont you just call Regional Acceptance and see what they can do. I had a similar experience and they corrected it with about 6days. I just called in and spoke with someone and it was handled.

Okay the same thing happened to my husband and I. But what is worst, they charged our bank card and paid someone else's account with that money. Admitting that they made the mistake, they promissed to correct it (LIE) and give us back our MULTIPLE NSF fees for the mishap (LIE). This happened at the end of May 2008 and it is now September. They never corrected it and couldn't care less. Now I have to find a lawyer as well but was wondering if there is someone who can represent us all or, since the incident that happened to you all is similar, what did the lawyer suggest that you all should do?
