You must give RA, or any other company, authorization to hit your account for the payment. To withdraw the monies without your permission would amount to wire fraud of sorts- which is a felony if I'm not mistaken. You cannot legally take monies from an individual's account w/o their permission. Its stealing. You have to give permission- via signing a form that authorizes automatic withdraws, etc. We've never had this happen. But we've had Regional say that a payment has bounced when we had proof it didn't. They still refused to credit our account. We even mailed them a payment and they demanded that payment the day they called vs. the agreement we had. The woman told my husband to put a stop payment on the check. When my husband demanded to be credited the $33 it would cost us to put a stop payment on the check, she told him that if he was going to be that way, she'd have us processed for repo! Um. Wow. Never had that happen. So, no. This isn't a case of poor folk crying over their car loans. |

| 3. Written by White, on 19-09-2008 15:28 Okay the same thing happened to my husband and I. But what is worst, they charged our bank card and paid someone else's account with that money. Admitting that they made the mistake, they promissed to correct it (LIE) and give us back our MULTIPLE NSF fees for the mishap (LIE). This happened at the end of May 2008 and it is now September. They never corrected it and couldn't care less. Now I have to find a lawyer as well but was wondering if there is someone who can represent us all or, since the incident that happened to you all is similar, what did the lawyer suggest that you all should do? |
